Highland Park man Henderson Stuart Leslight, 19, appeared in Southport Magistrates Court on December 3, where he pleaded guilty to a charge of driving over the middle alcohol limit as a learner, probationary, or provisional licence holder.
The offence occurred at Gooding Dr, Carrara, just before midnight on September 14 this year.
The court heard police were dispatched to the offence location to reports of a motorcycle crash that had left the rider injured.
Leslight, who suffered a leg injury, conceded to first responders he had taken the exit too fast and come off his vehicle.
A subsequent analysis revealed the defendant was riding his motorbike with a blood-alcohol content of 0.141 per cent in circumstances where he was required to return a zero reading.
However, due to Leslight’s ongoing recuperation from his broken leg – the defendant having presented to court in a leg brace and moving with the aid of crutches following surgery – he was not charged until November 2.
Leslight’s defence lawyer told the court her client presented with nil traffic history – not even a speeding ticket – and had completed the Queensland Traffic Offenders Program (QTOP).
She urged Magistrate Gary Finger to not record a conviction on the basis her client was almost finished a business degree at Bond University, and hoped to work internationally as a chartered financial analyst.
Mr Finger told the defendant he was “lucky you’re still with us,” and that, having reviewed the defendant’s QTOP material, he was confident the defendant knew he had “done the wrong thing” and wouldn’t be back before the court for similar offending.
He fined Leslight $1000 and disqualified his licence for five months, with no conviction recorded.
A Queensland Ambulance Service statement issued the day after Leslight’s collision said a male patient had sustained a leg injury following a motorcycle crash and was transported to Gold Coast University Hospital in a stable condition.
