A hoon with a “shocking” driving record was high on ice and speed when crashing into a tree and leaving his mate with a brain injury following a police chase.
Jacob John Timpany, 25, faced County Court on Thursday and pleaded guilty to a raft of charges, including reckless conduct endangering life, dangerous driving while pursued by police, conduct endangering persons, drug-driving and failing to report an accident.
Judge George Georgiou jailed him for 28 months, with a non-parole period of 19 months.
On February 7, 2023, Timpany was pursued by police after being spotted driving dangerously
During the 28-second chase on the Princes Highway, Timpany drove on the wrong side of the road at more than 100km/h, narrowly missing three cars and a truck carrying hot asphalt before colliding with a tree.
One of his friends, who was not wearing a seatbelt, suffered severe injuries including a fractured spine and collapsed lung, and was left with a brain injury.
In his sentencing remarks, Judge Georgiou told the court Timpany’s conduct was “outrageous”
“You put the safety of the occupants of your car and other road users in great danger,” Judge Georgiou said, noting it “must have been a terrifying experience” for the truck driver.
“The degree in recklessness. was high, and the potential consequences catastrophic.”
Timpany was on bail and a community corrections order (CCO) at the time of the offences, which was an aggravating factor, the court heard.
Timpany had been placed on a CCO in December 2022 after leading police on a separate chase.
He had five previous convictions of reckless conduct endangering serious injury between 2019 and 2022.
In addition, the court heard Timpany’s 37-page criminal record included a conviction for reckless conduct endangering life, four convictions related to dangerous driving, 10 convictions for driving while disqualified or suspended and six convictions of failing to stop on police direction.
Timpany has never had a driver’s licence and has breached every CCO he’s ever been placed on, the court heard.
The court heard Timpany was exposed to drug use, violence and neglect during his childhood.
He was diagnosed with ADHD in primary school and left school during Year 7.
Judge Georgiou said Timpany’s deprived upbringing mitigated his offending somewhat, but did not excuse it.
According to a psych report, he began abusing drugs and alcohol at a young age and used “a couple of grams” of ice daily.
Judge Georgiou said Timpany’s prospects were worse than guarded and noted any hope of Timpany’s rehabilitation is tied to whether he can remain abstinent from drugs and alcohol. Timpany was convicted on all charges and also fined $1000.
