A Marshall man accused of severely breaking a woman’s arm in an assault after a hours-long drinking session at a popular Pakington St pub says he was defending himself.

Alan Baker, 57, is alleged to have grabbed the woman around her arms and pushed her after he became angry, court documents reveal.

Mr Baker this week pleaded not guilty in the Geelong Magistrates Court to recklessly causing injury and unlawful assault.

When police arrived at the scene of the alleged incident on May 14, there were smears of blood on the wall, the court heard.

According to the court documents, Mr Baker and the alleged victim were at The Barking Dog in Pakington St, Geelong West and had been drinking for about four to five hours.

After leaving the hotel in an Uber with the victim, Mr Baker arrived at his home and realised his main door was locked.

The court heard an argument broke out because the victim had accidentally locked the main door.

After Mr Baker was able to open the door using spare keys, he became angry with the woman, the court was told.

He approached the victim, grabbed her around her arms and pushed her, according to court documents.

The victim fell to the loungeroom floor as Mr Baker yelled at her to “f---ing get up”, police allege.

Mr Baker allegedly grabbed the woman with one hand on the back of her neck and pulled her arm behind her back, before he pushed her to the ground again.

The court heard when police arrived at the scene, there were smears of Mr Baker’s blood on the walls in the lounge room.

Police said the victim suffered injuries including a “severe” broken arm and swelling and bruising to her neck.

When Mr Baker was interviewed by police, he denied assaulting the victim.

Mr Baker told police she was flailing her arms at him and her fingernails were cutting him.

“He stated he used his right arm to push her away from him to stop her harming him,” the court heard.

“He believes it was this action, used in self-defence, that caused the victim to fall over and stated the injuries weren’t caused by him.”

Mr Baker will next appear in court on December 14.
