A former touring member of rock band Yothu Yindi has avoided a mandatory three-month jail term for attacking his girlfriend with a butter knife because of the “exceptional circumstances” of his wife dying.

A FORMER touring member of legendary Territory rock band Yothu Yindi has avoided a mandatory three-month jail term for attacking his girlfriend with a butter knife.
David Malati Yunupingu pleaded guilty in the Darwin Local Court to aggravated assault on Monday after stabbing his girlfriend in the head with the knife and hitting her with a plastic chair.
As a repeat offender, Yunupingu was in line for a mandatory three-month minimum stint behind bars but judge Greg Cavanagh ruled the two months and six days he’d spent on remand were enough after learning Yunupingu’s wife had died in hospital on Friday.

Mr Cavanagh said despite Yunupingu having “more than one or two” priors for “bashing up” women, his wife’s death and his cultural obligations relating to her funeral amounted to “exceptional circumstances”.
Mr Cavanagh sentenced Yunupingu to four months in prison to be suspended immediately.
