FORMER Darwin City Council candidate and roundabout enthusiast, Des Fong, has been ordered to hand over financial documents to liquidators of two failed companies or face jail.
Fong pleaded guilty in the Darwin Local Court to four counts relating to the failure to produce the material over “an extended period of time” and after “multiple requests”.

Judge Elisabeth Armitage handed Fong a $4000 fine and a three-month jail sentence for the offending on Wednesday, saying the jail time would be wholly suspended on the condition that he cough up the required paperwork within two months.
Fong has several priors for similar offending and Ms Armitage said the current charges represented a continued failure to comply with his professional obligations.

Ms Armitage said while she accepted Fong had “a personality which contributes to this kind of offending”, that was no excuse.

“The reality is if he doesn’t have the personality or capacity to comply with the legislation, if he puts personal matters ahead of his professional responsibilities and his requirement to comply with the legislation then he should have recognised that many, many years ago and made a decision not to become, or continue to become, engaged in the kind of professional activities for which he was not, personality-wise, suited,” she said.
Fong will have until August 26 to comply.
