A father who was caught by his wife trying to have sex with her cousin without consent has been sentenced to prison.

The man, aged 23, was drinking with his friends in Tennant Creek in June 2017 after he played football.

The man left a house at around 8pm and saw the victim before calling her name out and approaching her.

The man tried to drag the woman into a laneway and asked her for sex.

The woman refused and said he was her cousin’s partner but he pushed her to the ground and got on top of her.

The man tried to kiss the woman’s face and bit her check causing her to scream in pain.

The man kept asking the woman for sex and attempted to pull her legs apart. The man’s wife then came across the commotion and he quickly jumped off the victim and ran away. The victim tried to get up off the ground however the man’s wife who was also her cousin punched her and hit her with a rock on her head out of jealousy.

During sentencing in the Alice Springs Supreme Court, the judge said that “any anger felt by your wife should properly have been directed towards you.”

The woman was taken to hospital for medical treatment and she said she had experienced both pain and embarrassment.

The man tried to argue that the woman grabbed him and asked him for sex while threatening him with a stick.

A jury rejected his defence and found the man guilty of knowingly attempting to have sexual intercourse with a victim without their consent.

The man was given a three year sentence but it would be suspended after 18 months to aid in his rehabilitation under several conditions.
