Judge allows variation in Zachary Rolfe’s bail condition and suppression of address

THE NT Police officer charged over the alleged murder of Aboriginal teenager Kumanjayi Walker has fronted court again today, with his lawyer successfully applying for a variation of bail and a suppression order.
Judge John Birch told the Alice Springs Local Court that the application to vary the bail of Constable Zachary Rolfe was to reflect a change of address.

“I note that the defendant is not moving out of the Australian Capital Territory and I also note that the prosecution consent to the variation of bail and the application is granted,” he said.
“And I note the matters contained in the affidavit in support of the application and the conduct that is alleged to have taken place towards the defendant, as well as his family.”
Defence lawyer David Edwardson also made an application to suppress the contents of an affidavit and his client’s change of address.
Prosecutor Collette Dixon said the Crown consented to the bail variation.
Judge Birch said he was satisfied the suppression order was in the best interests of justice.
“And I am satisfied that it is in the interests of justice that I make an order today prohibiting the publication of the defendant’s residential address or any matter which may directly or indirectly identify that address,” he said.

Constable Rolfe was charged with murder over the alleged shooting death of Kumanjayi Walker in Yuendumu in November last year.
Rolfe, who appeared by video link, will face court again for a preliminary examination mention in August.
