Bailey and Thomas McDonald, Jarrod Fiske and Codey Lawson plead guilty to assaulting St Albans Park man over bicycle

Together with two other men, twins from St Albans Park stormed into a man’s home and assaulted him while he was sleeping.

A group of young men ambushed another man and assaulted him while he was sleeping in his house after an argument erupted over a bicycle.

St Albans Park twins Bailey McDonald and Thomas McDonald, 20, Whittington man Codey Lawson, 23 and Armstrong Creek man Jarrod Fiske, 21, punched and kicked the man during a chilling assault in April last year over allegations the victim had sold parts of a bicycle.

All four men pleaded guilty at the Geelong Magistrates’ Court to several charges, including trespass and unlawful assault or assault in company.

Lawson and Thomas McDonald also pleaded guilty to possessing drugs of dependence.

The court heard Thomas McDonald, Lawson and Fiske entered the victim’s house through the back door while Bailey McDonald walked through the front to find the victim on the couch.

The four men kicked and punched the victim while he was sleeping.

They then dragged the victim outside where Bailey McDonald demanded he find the bike. When he learnt it was missing a wheel, he told the victim to “get the f------ wheel before I kill you c---“.

Thomas McDonald’s lawyer, Mary Foley, said he learned the victim had been selling parts of the bike after promising to fix it.

The victim managed to flee the four men but tripped as he was running towards the street and was further kicked and punched by Fiske and Bailey McDonald while he lay on the ground.

Thomas McDonald joined them and threw a punch towards his head.

Lawson stole a mountain bike before all four men left the scene.

Magistrate Franz Holzer said it was “shameful behaviour”.

“Frankly you’re cowards, each of you, to lay into (the victim).

“It’s simply not acceptable that you would take the law into your own hands in a way that has the effect that it has.”

Police found knuckle dusters, GHB and cannabis in Lawson’s room.

Cannabis was also found in Thomas McDonald’s room, alongside an ammunition shotgun cartridge.

Lawyer for Bailey McDonald, Amanda Hurst, said he was “so drug affected he doesn’t remember much of the offending”.

Ms Hurst said the four men had been at the victim’s house on a number of occasions to “buy drugs” and were familiar with the layout.

Adrian Paull, who represented Fiske, told the court he had spent 242 days on remand for these matters and asked Mr Holzer to consider sentencing him on the time served.

Mr Paull added Fiske had no reason for being at the home.

“He’s clearly not a leader (and) there’s no true motivation for him being there,” Mr Paull said.

Fiske was sentenced to 150 days imprisonment, time served.

Bailey and Thomas McDonald, who each spent 29 days on remand, and Lawson, who spent 65 days, were sent to be assessed for community corrections orders and will be sentenced later.
