’Shocking’ behaviour from NT fishing guide included ‘reprehensible racial slurs’ and ‘thuggish bullying acts’

FOOTAGE has emerged of an angry confrontation between two Territory fishing guides that led to one of them appearing in court.

FOOTAGE has emerged of a confrontation between two Territory fishing guides that led to one of them appearing in court.

Fishing guide Allan Beale from Darwin’s Barra Base was cleared of assault charges but was fined $6000 for interfering with commercial fishing equipment following the incident at Shady Camp on March 29 2014.

The video was uploaded to Youtube by Andrew Davey, who was fishing with Kaleem “Mickey” Qaiser from Springtide Safaris on the day the angry confrontation took place.

The drama erupted when Mr Beale, 55, thought Mr Qaiser had approached too close and ran over another boat’s fishing line earlier in the day, allowing a barramundi to escape.

Both guides had customers on board.

Magistrate John Neill said although there was “certainly evidence of that before me” it did not excuse Mr Beale nudging Mr Qaiser’s boat, shouting abuse and assaulting him.

“Your actions were self-righteous, aggressive and thuggish bullying acts,” Mr Neill said.

“It puts Mr Beale and his character in the poorest lights.

“To do this on the open river … was absolutely dreadful behaviour.”

It was alleged Mr Beale threw a punch at Mr Qaiser but missed and hit his hat.

Although hitting his hat would still be considered assault the judge found Mr Beale not guilty because he found evidence Mr Qaiser said “anytime anywhere and thereby plainly gave consent”.

For it to have been assault there would had to have been no consent.

Mr Neill said there was evidence that Mr Beale had threatened more than once to kill Mr Qaiser and did say words along the lines of “you black c**t”.

“The absolutely reprehensible racial slurs are extremely troubling in the context of this matter,” Mr Neill said.

After clearing Mr Beale of assault Mr Neill found him guilty of interfering with a commercial vessel.

“None of us ever fully grow up, I accept that ... But to be 55 years old and still seeking to resolve real or perceived slights by this sort of aggression, speaks ill of you,” he said.

“You approached him, you took the fight to him.

“You did so in the presence of your paying clients and in the presence of his paying clients and that is really a shocking piece of behaviour on your part.

“In every other way you’re a man of good character.”

Allan Beale made the pages of the NT News recently when he hit back at negative reviews of his business on Tripadvisor.

Customers alleged Mr Beale was abusive, smashed catfish over the head with a baseball bat and defecated off the front of the boat.

Mr Beale posted on the popular travel website defending the claims.
