THE dispute over a proposed Darwin Dan Murphy’s store is back before the NT Civil and Administrative Tribunal after legislative changes removed one roadblock standing in its way.
NTCAT previously dismissed an appeal of the Liquor Commission’s rejection of the plan on a technicality, since removed by the law change in March.

But counsel for Dan Murphy’s parent company Endeavour Drinks, Alistair Wyvill SC, told NTCAT on Friday the legislative solution was an imperfect one.
“I think it's fair to say, with great respect to those who were trying to solve the problem, the solution is clunky,” he said.
“But what is also clear is that behind (that) is the clear intention of parliament that there be a decision on the merits of this application.”
The parties will now continue to work towards workarounds for the remaining legal technicalities with the hearing set to resume next month.
