ENDEAVOUR Drinks has officially withdrawn its application in the Supreme Court to establish a Dan Murphy’s superstore, after March’s liquor legislation change.
The change in legislation allowed for the transfer of a liquor licence from an existing premises to one which had not been built yet, which had been blocking the Dan Murphy’s Darwin dream from becoming a reality.

Opposing lawyers then said the substitute of licence couldn’t be approved, given the difference in size and operation of the proposed Dan Murphy’s superstore and the former Stuart Park BWS bottle shop.
However, given the transfer of licence is now available, an Endeavour Drinks spokesman said the process would now be dealt with in the NT Civil and Administrative Tribunal instead, where the company would lodge an application by the end of this week.

“Endeavour Drinks has today (Thursday) withdrawn its appeal to the Supreme Court of the Northern Territory (SCNT) in relation to opening a Dan Murphy’s in Darwin,” he said.
“Following a legislative change in March, the Supreme Court NT appeal is now irrelevant, and the proceedings have been discontinued.”
The Dan Murphy’s superstore, which would be located in Eaton opposite Bunnings Warehouse, would have created a number of jobs for local construction companies as well as ongoing jobs for the ongoing operations of the outlet.

“We are committed to bringing Dan Murphy’s to the city by being the anchor tenant of a $30 million Darwin Airport development,” the spokesman said.
“We anticipate that if it goes ahead, this Dan Murphy’s store will create 30-35 new permanent jobs.”
The case was set to be heard with the full bench of the NT’s Supreme Court, before it was delayed due to the changes.
