Tech mogul Elon Musk has spectacularly claimed that today’s election in the US will be the “last” if Donald Trump doesn’t win - a claim that has been labelled as misleading by fact checkers.

The billionaire spoke on the Joe Rogan Experience yesterday, claiming the Democrats were planning to turn so many illegal immigrants into US citizens that it would swing future elections in their favour.

“If the Dems win this election, they will legalise enough illegals to turn the swing states and everywhere will be like California,” Musk warned. “There will be no escape. This is it. This will be the last chance.”

Musk has repeatedly made this claim in recent weeks. In a post on October 25, which got almost 17 million views, he said: “Their stated plan is to give them citizenship as soon as possible, turning all swing states Dem. America would then become a one-party, deep blue socialist state.”

BBC’s fact checking service spoke to voting and immigration experts who described this as a far-fetched claim.

It’s true that Democrats have expressed a desire for some undocumented migrants in the US to have “an earned pathway” to citizenship.

However, it is not their stated policy to grant them all this.

“Some undocumented migrants who arrive in the US could have a route to citizenship – but that would typically take a decade or longer, if they even have a path at all, which many of them will not,” Michelle Mittelstadt of the Migration Policy Institute, told the service.

In several posts, Musk mentions a 1986 bill which granted amnesty to approximately three million undocumented immigrants in the US.

This was passed by Congress and signed into law by Republican President Ronald Reagan. It forgave individuals who came into the US illegally but did not give them immediate citizenship.

“Perhaps Musk imagines that a president or administration can simply decree mass naturalisation of non-citizens without going through the prescribed individual legal processes, and that Congress and the courts would simply then accept this. That’s not how it works”, Walter Olson, a voting rights expert from the conservative think tank, the Cato Institute told the BBC.

‘Harris will freaking shut down X’

Musk is also convinced Vice President Kamala Harris will shut down X if she wins the election, claiming her administration will “sic the DOJ” on his social media giant.

“There’s no way that the Kamala Harris puppet regime would allow X to exist,” the billionaire said during the lengthy sit-down for the Joe Rogan podcast.

The Tesla founder made the prediction as he said he is still navigating the “advertiser boycotts” instigated by “left-wing NGOs” with “Orwellian names” ever since he purchased the platform in 2022, when it was still named Twitter.

“Some of the boycott is starting to lift and I think if Trump wins, I think we’ll probably see most of the boycott lift,” Musk said.

“But if Kamala wins, we will see that boycott get stronger. And they will freaking shut down [X].”

Asked if there was a pathway for a Harris administration to effectively shutter the platform, Musk - who has publicly endorsed Harris’ opponent, former president Donald Trump - responded bluntly: “Uh, yes.”

“They can sic the DOJ on [X],” he said.

“They have had this whole thing on hate speech, misinformation, or whatever, but they are the ones pushing misinformation. That doesn’t stop them from filing massive lawsuits and using the DOJ.”

Elsewhere in the interview, the SpaceX founder acknowledged his $44 billion purchase of the social media platform “a crazy move” and “way overpriced” - but suggested it was needed amid censorship fears.

“At the time, I think I said, ‘Look, this is existential to the United States. It’s existential to democracy,’” Musk said of his decision to acquire the company.

“If you don’t have freedom of speech, you don’t have democracy. If you don’t have freedom of speech, people cannot make an informed vote. If they are just being fed propaganda and there is no freedom of speech, democracy is an illusion.”
