Sam Kerr’s fight to clear her name has been hit with a major setback after her court case was delayed.

Kerr and her legal team were set to appear at Kingston Crown Court on Monday to fight to have her criminal charge of racially aggravated harassment thrown out.

Kerr was charged with intentionally causing racially aggravated harassment, alarm or distress to a male police officer in London on January 30, 2023.

The preliminary hearing scheduled for Monday has however been cancelled with the judge ruling it was “no longer needed”

“All issues between the parties have now been resolved,” a clerk at the London court said according to News Corp.

“The next date we have for the case is the trial date of February 3 next year.

“The judge agreed for this to be the case administratively. Monday’s hearing is no longer needed.”

The new date for Kerr’s hearing is February 3, 2025.

The hearings were delayed in April after the Crown Prosecution Service were unable to gather enough evidence, including CCTV footage, to cross examine the football superstar.

They were also yet to obtain written statements from the police officers involved in the incident.

The Crown Prosecution Service originally requested CCTV footage and statements from police on February 19, before following up on March 18.

Despite their attempts, lawyers told Kingston Crown Court that “exhibits were not received by the CPS”.

The incident allegedly occurred on January 30, 2023, just hours after Kerr scored an incredible hat-trick to propel Chelsea to a 3-2 FA Cup victory over Liverpool.

About 3am on the night in question, the Chelsea striker allegedly vomited in a taxi, was involved in a dispute about the taxi fare, and allegedly called an attending police officer a “stupid white bastard”.

New details of the 2023 incident came to light earlier this year with documents from Kerr’s March 4 appearance showing the 30-year-old was detained and spent time in a holding cell.

The Sydney Morning Herald reported Kerr was placed in a police custody suite inside a police station and was interviewed during that time.

News Corp reports Kerr’s legal team has requested for further video footage of the incident to be made available to them.

Kerr’s legal team is reported to have asked the Kingston Crown Court for any CCTV footage from outside a Twickenham station or from inside the custody suite to be provided to them.

Kerr’s team has also requested the audio that was recorded from the interview Kerr did with police while being held in police custody.

Kerr’s legal team filed documents with Kingston Crown Court in early April which assert she did not intend to racially abuse a police officer on the alleged drunken night out.

Kerr reportedly isn’t denying that she referred to the policeman as “white”, but will instead argue she said “stupid white cop”.

Her legal team is intending to argue an abuse of process by crown prosecutors after it took a year for her to be charged.

That delay was reportedly due to Crown Prosecution Service lawyers deciding what offence to prosecute her for.
