Delay in former treasurer Josh Frydenberg’s bankruptcy battle against former constituent

Ousted treasurer Josh Frydenberg’s bankruptcy claim against a former constituent who took him to court has been delayed.

Australia’s former treasurer's battle to have a former constituent declared bankrupt over unpaid fees has been delayed.

Josh Frydenberg was due to have a court hearing against former constituent Michael Staindl in the Federal Court on Thursday.

The climate activist challenged the then Kooyong MP and deputy Liberal leader’s eligibility to sit in parliament based on his entitlement to Hungarian citizenship through his mother.

Mr Frydenberg’s mother and her family fled Europe following World War II, and he said previously she was stateless.

The climate activist lost the case and was ordered to pay $410,000 of the then treasurer’s legal fees.

He has yet to pay up and Mr Frydenberg filed a creditor’s petition to ask the court to make a debtor bankrupt on May 25.

Both parties who did not attend court agreed to adjourn the case until next month, registrar Amelia Edwards said on Thursday.

It was appropriate to grant the request for the adjournment, she told the court.

Mr Frydenberg lost the blue-ribbon seat of Kooyong in Melbourne to independent “teal” candidate Monique Ryan.
