Victorian man Jesse Tovey allegedly stabs brother in heart, court told
A Victorian man is accused of stabbing his brother in the heart after an argument, a court has been told.
A Victorian man allegedly stabbed his elder brother to death, with the fatal blow piercing the man’s heart, a court has been told.
Jesse Tovey, 27, is charged with murder over the death of his elder brother Joshua at Hastings in January.
He faced a committal hearing on Wednesday in Melbourne Magistrates Court where pathologist Melanie Archer was questioned.
The 29-year-old alleged victim was found at the carpark of an Ultra Tune repair shop on January 18 about 7.12am when paramedics rushed to the scene, according to the pathologist statement.
“The deceased’s mother was woken by two male voices arguing outside her address. She looked out of her window and saw the deceased jumping the front fence and chasing someone believed to be her other son,” Dr Archer wrote.
That information was provided to her, she said.
“Death was caused by a stab wound to the chest, which injured the right lung and pierced the heart,” she wrote.
The elder brother also had three other stab wounds, including to the left of his neck, the right back of the shoulder and the left back of the shoulder, the court was told.
Defence lawyer John Saunders quizzed the pathologist about whether the shape of the wounds could indicate more than one weapon was used in the attack.
“We cannot rule that out,” Dr Archer told the court.
But she said it was a “standard statement” and she couldn’t think of a case where all the stab wounds looked exactly the same.
The court was told the brother’s mother was due to give evidence but was seeking legal advice and was “distressed”.
The hearing was adjourned until December.
