Brisbane ‘gunman’ in court over army training run with fake weapon
HE ran through a Brisbane suburb carrying what looked like an assault rifle, causing widespread panic. Now he’s appeared in court, and the magistrate isn’t happy.
A SERVING soldier who sparked alarm after he was spotted running through a suburb in Brisbane’s south clad in camouflage gear and holding a replica weapon has fronted court.
Nicholas Paul Latham, 26, faced Holland Park Magistrates Court this morning on a notice to appear for public nuisance after his “routine” training exercise through Rochedale South triggered a police hunt and forced schools into lockdown on December 2.
Police prosecutor Sergeant Brandon Coleman told the court officers received a number of triple-0 calls from the public, concerned about a man carrying “what appeared to be a weapon”.
“A number of police and Polair conducted searches and the person was located wearing full camouflage gear, carrying a backpack and holding a...metal pipe that (could resemble) a weapon,” he said.
He said police spoke with Latham, who was “compliant” and explained his reasons.
Asked whether any of the facts were being disputed, defence lawyer George Kalimnios said he was not in a position to say yet.
Magistrate Sheryl Cornack expressed surprise that Latham was slapped with a charge of public nuisance — and not going armed so as to cause fear.
She also began a heated exchange with Latham’s lawyers after it was suggested the case could potentially be sent to mediation.
“I mean I don’t have any power over what he police do but if I think they sent something that serious for mediation when there’s not a victim... the public wouldn’t appreciate that,” she said.
Mr Kalimnoas said he objected.
“...and I’m just asking to get some material, thank you,” Magistrate Cornack said in a firm voice.
“Your honour, I understand that,” he answered.
“Thank you!” she said.
“I’ve already made it clear it’s got nothing to do with me and it’s not my decision but I’m going to try to assess whether it would be likely it would be referred, or an appropriate case for referral, thank you.”
She later said if there was to be a mediation, “everyone who rang up triple-0... should have their views canvassed”.
The matter was adjourned to February 9.
Latham declined to comment to waiting media as he left the courthouse.
