‘Unable to move’: Boss’ horrific act during rape of employee
A Sydney boss has been sentenced after raping an 18-year-old migrant employee on her first day of work.

A boss who raped an 18-year-old employee on her first day of work has been sentenced to just two years and nine months behind bars.
The man was found guilty by a jury of raping the teenager on the floor of his office after plying her with alcohol during an “office party”.
He owned a cleaning business in Sydney’s inner west, had brought the woman in for a three-hour trial shift on the Friday.
She then formally started work on the Monday and was called into the “party” in the boss’ office about 1.30pm.
“There are more drinks in the fridge. We are going to enjoy the night. We are not going to let anyone go until 10pm,” the court heard the boss tell the group.
During the “party”, the court heard how the boss asked the woman why she “wasn’t drinking” on multiple occasions.
The victim told her boss she did not drink often, was 51kg and had only eaten an apple for breakfast.
The group drank Johnnie Walker blue label scotch and a bottle of tequila, with the teenager encouraged to do shots with the group.
Later in the afternoon, the boss witnessed the victim vomit in the bathroom from the alcohol before leading her into his office. He then removed her clothes and raped her.
The court heard how while the rape was occurring, the girl’s older sister rang multiple times with the offender telling the victim: “Your sister is persistently calling you”.
He answered the phone, to which the 21-year-old sister said: “Are you okay? I’ll come to pick you up”- but the victim was too drunk to speak.
He hung up the phone and continued with the assault.
On Friday, NSW District Court Judge Michael King said the perpetrator knew his employee was not consenting.
“There was nothing in which would suggest that she might have consenting or been willing to consent in circumstances where he was [significantly] older than her,” he said.
“She was an entirely new employee and [it was] in circumstances where she had worked at the business for just one day.”
Judge King said the fact he saw her vomit meant he knew she was extremely intoxicated.
“The accused was aware that she was substantially affected by alcohol and was not consenting to the sexual intercourse,” he said.
“She became, in effect, frozen and unable to move and wasn’t aware of what was happening.”
The court heard how throughout the rape, the boss questioned the teenager whether she had a boyfriend and whether she liked him.
About 6pm, the woman managed to get dressed and walk to the nearest train station – where her older sister eventually found her.
“Her sister said she was crying, her hair was a mess and her clothes were not on correctly,” Judge King said during his sentencing.
The victim then called her boss on the phone, saying: “Why did you do this to me? I can’t work tomorrow. How I come and work there? You already did this to me?”
He denied doing anything wrong.
The woman and her sister reported the crime to police.
Detectives found semen, blood and saliva on the floor of the man’s office.
He was charged with two counts of sexual intercourse without consent and one count of sexually touching another person without consent.
The court heard how after being charged, the rapist told his friend: “If you can help me out, just tell me, what is the best situation to get out of this.”
Judge King said the man still did not have an understanding of his offending and continued to deny his conduct was non-consensual.
The court heard how the boss – who is Nepalese – arrived in Australia in July 2019 to join his wife who had already been in Australia for four months.
Judge King sentenced him to a non-parole term of two years and nine months with a head sentence of five years and six months.
His sentence was backdated to when he was first taken into custody and will be eligible for parole on June 10, 2027.
Judge King said he would likely be deported after completing his jail term.
