Notorious ‘North Shore Rapist’ slapped with ankle monitor

Authorities have imposed a long list of monitoring conditions on an infamous rapist who terrified young women almost 30 years ago.

A notorious Sydney rapist will be subject to around-the-clock electronic monitoring amid fears he’s a “high risk of sexual reoffending”, a court has been told.

Graham James Kay, also known as the “North Shore Rapist”, on Thursday had a long list of monitoring conditions imposed on him for the next three years following his release from prison.

Kay was in 2000 sentenced to 20 years’ jail for a series of terrifying sexual assaults committed against young women and girls over 12 months across Sydney’s lower north shore.

During the attacks, which were each committed in 1995 and 1996, he held his victims at knifepoint, gagged their mouths and tied their hands.

He was released on parole in February 2015, but in April 2018, he contravened an extended supervision order – which placed strict conditions on Kay in a bid to protect the community – when he failed to disclose an intimate relationship.

Later that month, he again offended when he kissed a 16-year-old female supermarket worker.

The court was told the girl described the kiss on the cheek as “slobbery” and vigorously wiped her cheek following the unwanted kiss.

He was convicted and sentenced to a 15-month conditional release order to be served in the community.

Then in January 2022, Kay was again arrested after he stalked a young woman before attacking her inside her apartment complex.

He was jailed for two years for sexual touching without consent and stalk/intimidate with intent to cause fear of physical harm.

However, he had six months added onto his sentence after the Crown appealed against the severity of his prison term.

The court was told that Kay stalked his victim through a shopping centre, and then from the Sydney CBD to Haymarket, where he followed her into her apartment building and sexually touched her.

When the victim tried to exit the elevator, Kay reached under her dress and grabbed her vaginal area for several seconds, causing her to scream before he fled the scene.

He was released in September last year.

Last month, the court lifted a non-publication order over Kay’s name, which was imposed by a judge in 2020 after the rapist received threats and he lost his employment and accommodation.

Following his release, the state sought to impose a string of monitoring conditions, via an extended supervision order (ESO), to keep close tabs on him.

Kay did not object to the ESO; however, he objected to a proposed condition that he wear an electronic monitoring bracelet for the next three years.

He asked that he only be required to wear the electronic monitor for 18 months.

The court was told that according to a risk assessment report, Kay was gauged as being “a high risk of sexual reoffending”.

On Thursday, Supreme Court Justice Hament Dhanji ordered that Kay be subject to a three-year ESO, including that he wear an electronic monitoring bracelet.

Justice Dhanji noted that some of Kay’s past offences included following and stalking his victims and said that electronic monitoring could be used to monitor his movements.

“While electronic monitoring was not successful in deterring the defendant from offending in 2022, I would not discount the prospect that it will, in the future, have some deterrent effect,” he said in his judgment published on Thursday.

The 36 conditions of the ESO specify that Kay must report to a departmental supervising officer, provide a schedule of his movements if asked and live at an approved address.

He must not leave NSW and surrender his passport and cannot associate with anyone under 18.

He must not hire sex workers without prior approval from a case worker and must also inform authorities if he begins a sexual relationship or a friendship with a woman.
