Jury split on remaining charges facing Kyle Daniels

A jury has been unable to reach a unanimous agreement in the trial of Kyle Daniels, prompting a ruling by the court.

A jury has been unable to reach unanimous agreement on the remaining sexual abuse charges facing former swimming instructor Kyle Daniels.

On Friday, judge Kara Shead told the jury that she would accept a verdict by majority decision.

Judge Shead instructed the jury to continue deliberations with the aim of reaching a unanimous decision; however, she said the court would accept a verdict if all but one of the jurors agreed.

Mr Daniels is accused of inappropriately touching nine underage girls he taught at the Mosman Swim Centre between 2018 and 2019.

On Thursday afternoon, the jury returned unanimous not guilty verdicts for five of the 21 counts Mr Daniels was facing.

Mr Daniels was cleared of three counts of sexual intercourse with a child under 10, one count of the indecent assault of a person under 16 and one count of the sexual touching of a child under 10 years of age.

He still faces two counts of sexual intercourse with a child aged under 10, seven counts of sexual touching of a child and seven counts of indecent assault, including two considered alternative charges.

The jury foreman indicated regardless of time or further examination of evidence they did not believe a unanimous verdict could be reached on the remaining counts.

“Do you think it’s possible the jury will reach unanimous verdict or verdicts?” Judge Shead asked the foreman.

“No Your Honour,” he replied.

Judge Shead then asked if being given more time to deliberate over the weekend or revisiting evidence given during the trial would help arrive at unanimous agreement.

“I don’t believe there’s opinions that will change regardless of time,” the foreman said.

Jury deliberations are continuing.
