The mother of slain schoolgirl Charlise Mutten has been sentenced for breaking into a house, allegedly alongside fiance Justin Stein, who has since been charged with her daughter’s murder.

Kallista Mutten appeared at Campbelltown Local Court on Monday having pleaded guilty to break and enter a dwelling in company.

The 39-year-old was sentenced to a year-long intensive correction order as an alternative to jail, on the condition she undergo drug and alcohol treatment at a rehabilitation centre in Western Sydney.

Police alleged Mutten and Mr Stein broke into a property in the Blue Mountains in August 2021, making off with family antiques and two firearms.

Mr Stein remains before the courts on charges relating to his alleged involvement in the break-in, as well as a charge of murdering nine-year-old Charlise, whose body was located following a large scale search in January this year.

There is no suggestion Kallista Mutten was involved in her daughter’s death.

The court heard Mutten was in the process of undergoing drug and alcohol treatment at Odyssey House in Campbelltown and she was accompanied in court by a therapy worker from the centre.

Mutten’s lawyer Bet Turgut added she was co-operating with police in their inquiries regarding Mr Stein.

Ms Turgut told the court her client was currently in phase three of the rehabilitation program which involved assisting other residents and that she was “doing well”.

“These are very tragic circumstances and Ms Mutten is attempting to put her life back on track,” Ms Turgut said.

Ms Turgut said Mutten acknowledged that drugs had been a “major issue” for her and had contributed to a 2017 car accident that left a friend of hers dead and saw Mutten spend over three years and four months behind bars.

Magistrate Geoffrey Hiatt said he considered Mutten a “willing participant” in the break-in and that there was a degree of planning involved.

He said it was important in sentencing her to send a “clear message of general deterrence to others in the community”.

According to court documents, a large amount of silver tableware was taken during the break-in, along with the two firearms.

The documents stated Mr Stein’s family were distant friends of the owners of the Mount Wilson property, who used the home as a “weekender” and furnished it with antiques and family possessions.

Police alleged Mutten and Mr Stein were caught on CCTV footage breaking into the property wearing dark clothing with gloves and their faces concealed.

The documents state police believe Mr Stein allegedly acted as a lookout while Mutten “jimmied” the property’s flyscreen backdoor with a screwdriver.

“Once inside, Mutten commences ransacking the premises in search of valuables,” the court documents state.

CCTV footage allegedly captured Mr Stein saying to Mutten, “We’re not taking a f**king light” and “are you going to f**king talk to me or what, have you been through every f**king room?”.

Police allege in the documents that the pair then made off with the goods, with the victim’s son contacting police several hours later after realising the CCTV had been triggered.

According to court documents, Mutten “jimmied” a door to gain access to the property, stealing silver tableware along with the firearms.

Five months after the break-in Charlise was reported missing from a property in the Mount Wilson area of the Blue Mountains on January 13, 2022.

Her body was located five days later, dumped on the banks of the Colo River with, according to police, a fatal gunshot wound.

Police have charged Mr Stein, who was already in custody for alleged murder, with an additional count of aggravated break and enter.

Mutten was charged with accompanying Mr Stein on the break-in.

Charlise was living with her grandparents in Coolangatta and was visiting her mother over the Christmas school holidays when she disappeared.

Police will allege Charlise was alone in the care of Mr Stein the night she was allegedly killed.

At the time, Mutten was reportedly at a caravan park an hour away.
