Court hears men laughing as they allegedly rape a drunk, disabled girl

GOPRO footage of an alleged gang rape of an intellectually disabled girl revealed a man saying “one by one we will all get a f***”, a court has heard.

GOPRO footage of an alleged gang rape of an intellectually disabled girl revealed a man saying “one by one we will all get a f***”, a court has heard.

Shocking details of what was allegedly said during the 16-minute video was heard at the trial the 16-year-old’s alleged attackers, Kurt Stevenson, 26, Andrew Waters, 24, and Tristan Carlyle Watson, 26, who have all pleaded not guilty at the Downing Centre District Court to multiple sexual offences.

In her closing address to the jury, Crown Prosecutor Sharon Harris outlined what was allegedly said by the men in the footage which included, “are you ready for the next one?”, “next, next, next”, “put it in you s*** c***” and “just bend her over the bed”.

“(The victim) is not spoken to nor is she speaking, she is spoken about, her wishes throughout the entirety of the footage are ignored,” Ms Harris said.

The Crown alleges the girl, who can’t be identified, was raped by the three men while other men watched at a house party at St Clair, in Western Sydney in May 2015.

The court had previously heard the girl did not know she had been raped until police came into possession of the GoPro footage and tracked her down.

The defendants claim the girl was an active participant in the sexual activities and can be seen moving up and down while having sex with Stevenson.

Ms Harris told the jury the girl was too drunk to consent to sex.

“(In the footage) she is flopping, slow or sleeping, Kurt Stevenson has to direct her take her clothes off, to move or sit up,” Ms Harris said.

The footage was shown to the jury in a court which was closed to the public. Not even the alleged victim has seen the footage.

Ms Harris described that at one stage Stevenson can be seen having sex with the girl while Waters stands nearby naked with an erect penis “waiting his turn”.

She said at another point the GoPro pans the room and the men watching or can be seen laughing.

Ms Harris summed up the evidence provided by Professor Susan Hayes who determined the girl had a mild intellectual disability with an IQ of around 60 when the average person has an IQ of 100.

“She was a vulnerable young lady without the coping skills to protect herself,” she said.

The court heard she was invited to the party by Carlyle Watson who she had met over Facebook a few days earlier.

Defence lawyer for Stevenson, Michael Smith said that the one alcoholic beverage and “thumb nail” of cannabis the victim said she had that night would not have rendered her so drunk that she “blacked out”.

He also said there was no evidence to support her claims that she was forced to drink a spiked beer.

“(The victim) went into the witness room and she repeatedly told lies, and then she lied again, and then she lied to cover the lies,” Mr Smith said

He told the jury she was so unreliable they needed to set aside her evidence.

The trial continues.
