Mr Khan has been in hospital in a serious condition since sustaining serious, but non-life-threatening injuries in the September 4 blaze that police will allege he started deliberately.

Emergency services were called to the Darling Street store at about 4am on that Thursday, where they found the building well alight.

The disaster killed three people who lived in the apartments above the store: Bianka O’Brien, 31, her one-year-old son Jude, and Chris Noble, 27.

Another three people were injured.

Mr Khan was pulled from the rubble where he was found pinned underneath a commercial fridge with only his hand sticking out, authorities said at the time.

It was unclear as to why he was in the store at that time of the morning.

Mr Khan’s wife Naima has been by his side and maintained his innocence throughout the ordeal.

“Just because he is a survivor doesn’t mean he has done anything wrong,” she told Nine News.

Bianka O’Brien, 31, and her baby son Jude are farewelled at St Joseph’s Catholic Church in Rozelle.
