Phillip Richard Hanslow is charged with escalating a long-running feud between the neighbours by confronting Mr Sebastian outside their Maroubra homes on January 23.
Police were called to the beachside suburb about 1.30pm for a dispute between neighbours that allegedly involved threats.
It’s alleged Mr Hanslow had threatened to kill his famous neighbour during an argument about their shared fence.
Mr Hanslow previously told reporters he was on the toilet when police arrested him and charged him with stalking with intent to cause physical harm and damaging property.
Sydney solicitor Bryan Wrench represented him in Waverley Local Court on Thursday after he previously appeared in court without a lawyer.
Mr Wrench told the court the charges had arisen out of a neighbourhood dispute over a fence.
“This is a matter where the dispute arose because Mr Hanslow was fixing his fence to match the look of Mr Sebastian’s house at the time,” he said.
“We understand Mr Sebastian took offence to that.”
The court was told the fence has now been repaired to suit the “concrete complex” look of Mr Sebastian’s multimillion-dollar home.
Mr Wrench said the music star had been served with a subpoena for CCTV footage and any phone camera video related to the alleged incident.
“It would show Mr Sebastian with a brick in his hand towering over my client,” he said.
“That’s why we took the drastic step of serving Mr Sebastian.”
The court was told there was a “very helpful camera” placed near where the dispute was alleged to have taken place.
Mr Wrench said the dispute was unlikely to be resolved, but he hoped the CCTV footage would result in a dismissal of the charges.
Magistrate Jacqueline Milledge adjourned the subpoena matter until March 23 to allow Mr Sebastian’s legal team to collect the footage.
“Good fences make good neighbours,” she quipped.
Mr Hanslow is restricted by an interim apprehended violence order taken out by police to protect Mr Sebastian.
Under the terms of the court order, the 66-year-old is prohibited from contacting the inaugural Australian Idol winner or entering his property.
The 66-year-old is also banned from possessing a firearm or illegal weapon.
The court was previously told Mr Hanslow was struggling with a myriad of health issues and required bowel surgery.
Outside court, he told reporters he had spent “four hours on the operating table” to have part of his bowel removed.
The alleged death threat is believed to be the fiery culmination of six years of tensions between the neighbours that began in 2016 when Mr Sebastian and his wife Jules were building their home.
The couple bought their $3.1m home in Maroubra in 2013 and spent nearly three years overhauling it to create their “fortress-like” house.
