MODERN Family actress Sofia Vergara has every reason to smile after scoring a major victory against Nick Loeb over their frozen embryos.
ACTRESS Sofía Vergara scored a major victory in her contentious court battle with bitter ex-fiance Nick Loeb over their frozen embryos.
A Louisiana federal judge tossed the case out on Friday, saying the embryos — which have been cryogenically frozen since the former couple’s IVF treatment in 2013 — are citizens of California, where they were conceived.
The New York Post reports Louisiana is the only US state where embryos have legal rights of their own, rather than being considered the belongings of their parents.
Loeb, who wants to be a dad, was trying to ship the embryos to Louisiana from Beverly Hills, California.
The suit was filed on behalf of the embryos — named Emma and Isabella in court papers — demanding he get custody and alleging that the Modern Family actress “effectively abandoned” them.
Both parties declined to comment.
Vergara is married to Spider-Man hottie Joe Manganiello.
