‘St Kilda Schoolgirl’ Kim Duthie loses case against Ricky Nixon’s book

RICKY Nixon will be allowed to publish salacious claims of his relationship with Kim Duthie in his his tell-all biography, a judge has ruled.

RICKY Nixon will be allowed to publish salacious claims of his relationship with ‘St Kilda Schoolgirl’ Kim Duthie in a hard copy version of his tell-all biography, a judge has ruled.

Ms Duthie, 22, sought a Court of Appeal injunction against two chapters detailing accusations against her from being released in the warts-and-all account titled My Side.

In a brief address Justice David Beach dismissed the application but ordered that Mr Nixon could not publish anything about Ms Duthie in electronic form until June 9 2016.

He said the matter would be deferred to the torts list of the Supreme Court.

After the ruling, Nixon tweeted: “Winner winner ChickenDinner can fully publish yeeesssssssss ... Toot Toot!!!”

Ms Duthie was 17 at the time and wanted to strip chapters six and seven from the book.

Will Houghton, QC, for Ms Duthie, earlier told the court that publishing parts of the book would cause hardship for his client.

“He seeks to portray Ms Duthie as the temptress, the wicked woman, and the seductress, and worse, a slut and a prostitute,” Mr Houghton said.

“The only possible loss to be suffered by Mr Nixon…would be a temporary suspension of his ability to publish this terrible book.”

Supreme Court Justice David Beach previously ordered that excerpts from the book read out in court, and Nixon’s and Ms Duthie’s affidavits be suppressed. No further suppression orders were made today.

The disgraced AFL player manager’s lawyer, David Gilbertson, QC, said Ms Duthie was “an inveterate liar”.
