Police will head to court on Monday to try and keep the Porsche driver at the centre of the Eastern Freeway crash behind bars.
Richard Pusey, 41, has made an application for bail which will be held at the Melbourne Magistrates’ Court.
But his bid for freedom will be strongly opposed by police.
Victoria Police Chief Commissioner Graham Ashton confirmed the move on Friday.
“We’re expecting a bail application, I think it’s Monday — we’ll be opposing bail.”
The basis of their opposition would be the seriousness of the alleged offending.
“The actions we’re alleging he engaged in we believe is at the very high end of that indictable offence. We’ll be saying that’s in the public interest.”
Pusey was charged with nine offences, including failing to render assistance, reckless conduct endangering serious injury, and three counts of committing an indictable offence while on bail.
He was urinating on the side of the road when a truck driven by Mohinder Singh veered to the left and killed four police officers who had been speaking to him after he was pulled over after allegedly driving his $150,000 Porsche at 149km/h on April 22.
The Herald Sun understands he has been using his time in Melbourne Assessment Prison to prepare a dossier on how he is being treated in custody and will use it as part of his bail application.
Pusey has been heard calling police “dogs” and claiming the case against him was a conspiracy.
Mr Ashton said the bikie busting Echo Taskforce was not assisting the investigation into the Eastern Freeway crash.
Police could use a video he allegedly took of the crash scene to keep him from being released, it has been reported.
Pusey is in protective custody at Melbourne Assessment Prison.
He was taken into custody on April 23, the day after the crash that claimed the lives of four police officers.
Leading Senior Constable Lynette Taylor, Senior Constable Kevin King, Constable Josh Prestney and Constable Glen Humprhis will be honoured in a public service once the lockdowns are lifted.
Pusey allegedly filmed himself taunting Sen Con Taylor as she gasped for help.
