A freshly bailed Toby Mitchell has spoken of how he plans to spend his nights under strict curfew over Christmas.

Mitchell, president of the notorious Mongols outlaw motorcycle gang, was on Wednesday freed on bail over the November 15 street fight.

A homeless man is believed to have knocked out bikie boss Toby Mitchell during an ugly Southbank assault.

He posted a photo on Instagram of a brand new PlayStation 5, saying: “My new best friend will get me through the next few months of 8pm curfews.”

It comes as he celebrates his 46th birthday, including with a “birthday shave” at a barber.

Mitchell was already on bail over an assault in South Yarra in October at the time.

He had been partying with booze and women at the glamorous Soho bar before the assault in Southbank.

A witness told the Herald Sun the former champion kickboxer was involved in an altercation with a group of young men, before a homeless man intervened.

“I heard the homeless guy say: ‘Pick on someone your own size,’” the witness said.

“Toby took a swing at the guy and he swung back … (Toby) was out cold for about five minutes.

“The girls (Toby) was with ran off and his friends had to carry him away. It happened really quickly. The homeless guy just walked away.”

The fight happened at Queensbridge Square about 3am and is believed to have been captured on CCTV.

Echo Taskforce detectives on Wednesday charged Mitchell with affray and committing an indictable offence while on bail.

He spent just 12 hours in custody before he was released on bail, despite police arguing he posed an unacceptable risk to the public and should remain locked up.

His lawyer, Damian Sheales, told the Melbourne Magistrates’ Court the bikie boss “came off second best” during the assault, which lasted about 40 seconds.

The court heard Mitchell and about 15 men and women were walking down Southbank Promenade when he allegedly got in a yelling match with an unknown man sitting on the ground near the Sandridge Bridge.

Detective Acting Sergeant Jordan Collinson told the court Mitchell’s mates tried to hold the burly bikie back as he threw a series of punches to the face and uppercuts to the man’s gut.

But he allegedly swung back and landed a punch to Mitchell’s face, knocking him unconscious, the court heard.

A dazed Mitchell was helped away by his mates and neither police nor paramedics were called.

It was also revealed in court Mitchell had spent the past two days in the Royal Melbourne Hospital and had only checked himself out for a few hours to feed his pets when police arrested him at his Southbank home early Wednesday morning.

He is due to undergo surgery on Monday, his lawyer told the court.

Mitchell was already on bail after being charged over claims he struck a man three times in the head outside the Gilson Cafe on Domain Road on October 4.

Magistrate John Bentley said seeing Mitchell in court again was “almost deja vu”.

Mr Bentley said he would again grant bail, but this time he would be adding a strict 8pm-6am curfew and warned Mitchell “better have Netflix”.

The court heard Mitchell suffers a series of medical issues after being shot in the stomach several times outside Doherty’s Gym in Brunswick in 2011.

The investigation is ongoing and anyone with information is urged to contact Crime Stoppers on 1800 333 000 or submit a confidential crime report at crimestoppersvic.com.au.
