A handwritten note Aussie NBA star Jock Landale passed to the son of TV and footy legend Sam Newman after an alleged assault will be probed amid legal action against the basketballer.
The Herald Sun earlier this year revealed former Geelong Grammar student Max Jones had launched legal action against the exclusive private school and Landale.
Jones has accused Landale of pushing him to the ground and jumping on his stomach when they were students.
Lawyers for Mr Jones have demanded that Landale provide details about a handwritten note he passed to Mr Jones following the alleged assault.
Documents lodged with the Supreme Court have asked Landale to explain the reason why he wrote the note, which read: “hey maxy boy! I hope your (sic) ok sorry to hear the bad news! Hope you get well soon. Jock xoxo”.
Landale will be forced to detail the “bad news” he was referring to in the message to Mr Jones, which also featured a border drawn around it and the word “sorry” underlined.
It comes after the Herald Sun revealed the legal battle between the high-profile alumni in March.
Mr Jones claimed Landale, now one of Australia’s highest-paid sports stars, committed battery against him when he repeatedly jumped on his lower stomach to the beat of a song playing through a portable speaker.
He alleged that the attack took place inside Geelong Grammar’s Manifold House common room on February 7, 2013, when Mr Jones was in year 10 and Landale was in year 12.
Mr Jones’ legal team will probe Landale about “any other incidents of bullying, intimidation, and/or assaults perpetuated by you upon other students at the school”.
Geelong Grammar will also be required to provide details about any other bullying allegations made against Landale or incidents involving the Boomer during his time at the school, and whether he was disciplined over the matters, including any detentions or suspensions he may have received.
A phone call to Mr Jones’ mother from the school the following day and staff supervision at the boarding house on the night of the alleged assault will also be questioned.
Mr Jones claimed he was forced to undergo a discectomy – the removal of discs in the spine – as a direct result of the incident.
He launched legal action with law firm Arnold Thomas and Becker against the school with Newman’s “full support” for alleged negligence and failing to protect him from bullying at the hands of other students.
Landale and Geelong Grammar have denied these claims.
It comes as Landale returned home to Melbourne this week following his $48m signing with the NBA’s Houston Rockets.
Before that, he earned $2.3m a year playing as a centre for the Phoenix Suns.
Landale and Geelong Grammar were contacted for comment.
A trial has been set for January 30 next year.
