Jayson Ziro sentenced to jail over the crash that killed his passenger Jack Baho

A judge questioned whether a hoon jailed for killing a passenger in a high-speed crash was remorseful after he was caught speeding near the crime scene months later.

A young hoon jailed for killing a passenger in a freak car crash where police allege two drivers simultaneously ran red lights was caught speeding near the crime scene months after the fatal smash.

Jayson Ziro, 21, was sentenced to 26 months jail over the 2018 smash that saw two young men who had been out partying allegedly run red lights at the exact same time.

Ziro, then an 18-year-old P-plater, had been out drinking at a Prahran nightclub before he and a mate jumped in his car in the early hours of the morning, on Sunday November 25.

He had a blood alcohol of 0.046 when he sped through the Greenvale intersection at 22km/h over the limit.

Marvin Younis, 25 and also from Roxburgh Park, was allegedly driving 92km/h in the opposite direction with three people aboard, with the two mens’ cars smashed into each other, killing Younis’ front seat passenger Jack Baho, 20.

Despite the deadly smash, a County Court sentencing hearing was told Ziro was busted just four months later driving more than 20km over the speed limit near the scene at night time.

Judge Rosemary Carlin said if Ziro was “genuinely remorseful” she expected he would have been more cautious driving in that area.

“I am not persuaded that you fully appreciate your role in Mr Baho’s death,” she said.

But she said Ziro was not “solely responsible”, and that reduced the gravity of his offending – but not his moral culpability.

“It took another young man to simultaneously flout the law to bring about that tragic consequence,” Ms Carlin said.

Ziro, sentenced for culpable driving causing death, will serve a minimum 14 months in jail.

“Your driving not only brought to an end the life of another man, it shattered the life of those who care for him,” Ms Carlin said.

Had Ziro not pleaded guilty, Ms Carlin said she would have imposed a four year sentence, with a non-parole period of three years.

Younis is yet to have his matter completed in court.
