Fourth teen charged over deadly daylight attack that left Pasawn Lyhym dead

A court has heard the horrific brawl that left 16-year-old schoolboy Pasawm Lyhym dead involved “allegations of retribution and gang violence” as a fourth teen is charged.

The horror daylight attack that left 16-year-old schoolboy Pasawm Lyhym dead involved “allegations of retribution and gang violence” as a fourth teen has been charged over the shocking brawl, a court has heard.

Fresh details over the murder case were aired in Melbourne Magistrates’ Court on Wednesday as one of the boys charged over the attack, 18-year-old Ngor Dao, intends to strike a plea deal with the prosecution.

A boy, 17, charged with Pasawm’s murder is due to face a children’s court tomorrow (Thursday) while another boy, 17, was charged in June with affray.

Meanwhile, it can be revealed that a fourth boy, also aged 17, has since been charged with affray.

Disturbing footage captured the moment Pasawm was chased by two teens wielding machetes in the moments before he was stabbed to death near a bus stop after school on Thursday, May 18.

One of the knife-carrying teens captured on camera was wearing a school uniform, tie and backpack as he ran after the Year 11 Staughton College student.

New details in the homicide case were aired in court on Wednesday morning as a defence lawyer fought to keep information about Mr Dao’s matter from the public.

The 18-year-old, from Burnside Heights, has been charged with four offences, including reckless conduct by swinging a machete at a victim and putting them in danger of serious injury, using a prohibited weapon being a machete, affray and intentionally causing injury.

He is the only one of the four boys charged who can be legally identified because he was an adult at the time of the brawl.

The court heard Mr Dao made a plea offer last month, with prosecutors asking for a three-week delay so they could speak to an alleged victim.

Defence lawyer Josh Harris sought to deny the public access to his client’s charges, telling the court, “I just worry if the charge sheets were released at this stage there could be some issues with Mr Dao’s privacy”.

“The other three co-accused are 17-year-olds, my client was 18 for one month,” he said of Mr Dao, who appeared in court via video link wearing a suit and tie.

“The offending in the matter does involve some allegations of retribution and gang violence.”

But Magistrate Donna Bakos replied that “privacy is not a matter that I can take into account” under the principles of open justice.

Her Honour approved the documents for release, and ordered Mr Dao return to court next month.

Police earlier said that the fatal incident involved two groups of students from two different schools.

“They are schoolchildren around the 15 or 16-year-old mark and they know each other,” Detective Superintendent Janet Stevenson said in May.

“They’ve met down near the Sunshine bus station and that’s where an altercation has taken place.”

Mr Dao will return to Melbourne Magistrates’ Court on November 1 where his case was expected to resolve.

The three 17-year-olds, who cannot be identified for legal reasons, will have their cases continue to progress in the children’s court.
