The Porsche driver who filmed the aftermath of a truck crash that killed four police officers in Melbourne has been sentenced for sharing horrific images of the scene with a financial services watchdog.
Richard Pusey uploaded graphic pictures of the April 2020 Eastern Freeway crash in a Google review of a Porsche dealership and in a complaint to the Australian Financial Complaints Authority (AFCA) in November 2021.
The 44-year-old, who now uses they/them pronouns, was convicted of two charges of using a carriage service in an offensive manner last month.
Pusey was sentenced to 10 months and one month in prison for each charge at Sunshine Magistrates Court on Monday morning, with the sentences to be served concurrently.
Magistrate Michelle Mykytowycz said the images were “graphic” and denied police officers Leading Senior Constable Lynette Taylor, First Constable Glen Humphris, Senior Constable Kevin King and Constable Josh Prestney any dignity in death.
“It is hard to conceive of a more serious example (of using a carriage service in an offensive manner),” Ms Mykytowycz said.
“The four images were graphic in nature, showing variously in each image one or four of the deceased officers lying in place where they died.
“The circumstances of their death and their injuries suffered were plain to see. And once seen, these images cannot be unseen.”
Ms Mykytowycz said Pusey’s actions after the tragedy would horrify an average member of the community.
“The use of (the images) to accompany a motor vehicle insurance complaint was nothing more than gratuitous in my view and denies the dignity each police officer deserves, having died while exercising their duty as police officers,” she said.
“I did not hesitate to find that a reasonable person would not find the graphic nature of the images and the unjustified and baseless sending of these as part of a AFCA online complaint as offensive, having regard to morality, decency and propriety generally accepted by adults in the community.”
Pusey has been behind bars since February 7 after their bail was revoked when the latest charges came to light.
