Champion boxer agrees not to touch cash in $1m fitness empire stoush

A professional boxer and his former best friend are in a bitter court battle after the pair built a $1m Melbourne fitness empire.

A professional boxer has agreed in court to not withdraw, transfer or deal with $255,000 as part of a legal stoush with his former mate and business partner in a $1m fitness empire.

Jason John Mallia made the undertaking not to deal with the monies, held in a Bank of Melbourne account, through his barrister Marcus Clarke KC in the Federal Court in Brisbane on February 14, court documents state.

Damon Falzon Pty Ltd, a company wholly owned by personal trainer and fitness businessman Damon Jake Falzon, 28, from Newport in Victoria, has sued Mr Mallia, Jason Mallia Holdings Pty Ltd and their jointly owned company Jason and Damon Fitness Pty Ltd.

Mr Mallia’s undertaking to not touch the cash in the bank account was made after a brief preliminary hearing before Judge Helen Rofe.

Jason and Damon Fitness Pty Ltd has a fitness app on the Apple Store called Crew Fitness and Performance.

They also have a gym in Braybrook in Melbourne.

Mr Mallia, 29, from Moonee Ponds in Melbourne, is an up-and-coming welterweight boxer, and became Australian welterweight champion in September last year he won a bout against Ben Horn over 10 rounds in Melbourne.

The case is due to return to court later this month.
