Accused mushroom cook murderer Erin Patterson not included in Don Patterson’s will

Erin Patterson was shunned in the multimillion-dollar estate of her former father-in-law, who died after allegedly eating poisonous mushrooms during a lunch at her Leongatha home.

Accused mushroom cook murderer Erin Patterson has been shunned from the $2.6m will of her former father-in-law and alleged poison victim Don Patterson.

Supreme Court documents reveal Don divided his mass estate equally between his three sons, Simon, Matthew and Nathan Patterson and daughter Anna Terrington.

Nothing was left to Simon’s estranged wife, Erin, who was charged with the murder of Don, his wife Gail and Gail’s sister Heather Wilkinson.

The trio died after allegedly eating poisonous mushrooms in a beef wellington dish during a lunch at Erin’s Leongatha home on July 29 last year.

The dish, cooked by Erin, was allegedly laced with death cap mushrooms.

Don’s grandchildren, including Simon and Erin’s two kids, were also not listed as beneficiaries.

In the will, dated November 2, 2018, an inventory of the beloved teacher’s assets valued his estate at $2.6m.

This included a $680,000 Range Court home in Korumburra and a $695,000 North Rd unit in Oakleigh East.

Don had about $634,000 in super, $516,000 in shares, $88,000 in cash and a $30,000 campervan.

The will was this week granted probate, giving Don’s executors and two youngest kids, Nathan and Anna, the ability to divide the estate between the beneficiaries.

The status of Gail’s probate application remains at “further information requested” as of Wednesday.

Meanwhile, almost 12 months on, Don’s official cause of death remains a mystery.

According to the affidavit of the executor document “the full death certificate showing the cause of death has not as yet been finalised, as the death of the deceased is subject to a coronial enquiry”.

The 70-year-old died at The Austin hospital on August 5, a day after Gail and Heather passed away.

It’s believed the trio and Heather’s husband Ian Wilkinson, who survived the meal, all suffered from food poisoning symptoms before they were rushed to hospital.

In May, Erin pleaded not guilty to three counts of murder and five counts of attempted murder.

The attempted murder charges relate to Ian and Simon, who was due to attend the lunch but pulled out at the last minute.

A further three attempted murder charges relate to Simon with the location of the alleged crimes occurring in Korumburra, Howqua and Wilsons Promontory.

Erin is due to face court for an administrative hearing in August.
