A new father has been bailed after he allegedly killed a thief with a bat during a foiled break-in attempt at a takeaway store in Geelong.

A new father has faced court after he allegedly killed a thief with a bat outside a Geelong takeaway shop.

Jake Mouat, 32, was granted bail at Geelong Magistrates’ Court on Friday after he was charged with manslaughter following the death of Norlane artist Sheldon Broderick.

Mr Mouat’s lawyer Paul Stefanovic said the new father was currently the sole provider for his family and wouldn’t be able to pay his mortgage if he was remanded.

Magistrate Peter Mellas said the Corio man had a stable residence, employment, family support and showed no substantial risk of further reoffending.

It’s alleged that police were called to Corangamite Dr on June 20 about 5am after reports of an altercation between the two men.

Mr Mouat allegedly confronted Mr Broderick after he was caught breaking into Rays Fish and Chip & Pizza shop, attempting to steal a charity tin containing $15.

An alleged altercation between the two left Mr Broderick with life threatening injuries but he later died in hospital on June 23.

It’s understood Mr Broderick, 48, was allegedly hit with a bat.

Mr Broderick’s eldest daughter Schehara said her father was a “hero” to her and her siblings.

“He was a jokester. He was very funny and everyone that met him, loved him,” she said.

“He was a good dad when he was there. He just had a heart of gold.

“His life and his situation wasn’t the best, but he would do things for other people and would never say no when anyone asked him for help.”

Mr Broderick’s mum Janice said she became estranged from her son in recent years but would remember him as a “cheeky little boy” who was “always up to mischief”.

It’s understood Mr Broderick was on the waiting list for social housing and had been couch surfing in recent months.
