UPDATE 3.27pm: PREMIER John Brumby says the issue of conjugal visits given to the man who killed Daniel Valerio is not a matter for the Government.

A Herald Sun investigation has learned Paul Leslie Aiton has been allowed to marry and buy a house with his bride, Linda, while serving a 22-year sentence for the murder of toddler Daniel.

Aiton's four-hour conjugal visits were approved by prison authorities and occur in a special unit at Marngoneet prison in Lara.

But Mr Brumby said such issues were not the concern of governments.

"These are not matters for ministers or Government, they are matters for the independent board," Mr Brumby said.

"This was a particularly awful crime, it was a heinous crime, it was a terrible crime and a shocking crime.

"But how prison authorities respond in terms of how they prepare prisoners towards the end of their term … is a matter for them.

Opposition leader Ted Baillieu said a review of conjugal visits for prisoners must be undertaken quickly.

He admitted to being "surprised" that Aiton has been allowed four-hour conjugal visits in a special prison unit.

"We support a review but understand the sentiment that says it shouldn't happen in this particular case and I would like to take Correction Victoria's Bob Hastings advice," he said.

Daniel Valerio's brother, Ben, has also hit out at news his brother's killer has been allowed to marry while in prison.

Mr Valerio, who was four when Daniel was killed, said he was shocked to learn that Aiton had started preparing for his release from prison.

"I'm not really happy about it. I don't understand the reason for giving some a prison sentence for 20 years for killing a two year old, they shouldn't get let off early," Mr Valerio said.

"People that could do that to a two year old...I'd ban (everything) from them.

"In my eyes, 20 years of his life isn't worth one day of Daniel's," he said.

Mr Valerio said he didn't believe Aiton could be rehabilitated.

"Who's to say he's not going to do it again?" he said.

Aiton, who bashed Daniel to death in 1990, met his wife while jailed in Ararat Prison.

Ms Aiton, who has a love heart and her husband's name tattooed on the outside of her wrist, continued to visit her husband after he was transferred to the medium security prison.

 Ms Aiton said she did not know when her husband could be released, but said he was rehabilitated.

"What happened to Paul all those years ago was then. It's not happening now," she said.

"He has done his time, he has done everything that everybody has asked him to do."

Asked whether her husband was a changed man, Ms Aiton said: "Of course he is."

Aiton, who is 188cm tall and weighed 105kg when he beat Daniel to death after months of abuse, will be eligible for parole next month after serving the minimum 18 years of a 22-year sentence.

People Against Lenient Sentencing spokesman Steve Medcraft said the conjugal visits showed the Government was not serious about cracking down on crime. "The Government is living in airy-fairy land," Mr Medcraft said. "Some of the prisons are like hotels ... I thought prisons were for punishment."

A Corrections Victoria spokesperson said: "Corrections Victoria under the new Commissioner is reviewing and tightening rules around prison weddings and residential visits for serious offenders."

Daniel Valerio's murder shocked the nation and led to mandatory reporting of child abuse after it was revealed doctors, police and community services workers had been warned the boy was being beaten before his murder.

Aiton, now 49, has showed no remorse for Daniel's murder. An autopsy found Daniel, the son of Aiton's then-girlfriend Cheryle Butcher, suffered 104 bruises and two broken collarbones.

Prison sources said the relationship with his now wife blossomed after Ms Aiton contacted her future husband offering to help him rebuild his life.

The couple bought a $170,000 country property together in 2007, where Aiton is expected to live when he is released.

Ms Aiton visits her husband weekly, often accompanied by her daughter, who is aged about 12.

Aiton is housed in the prison's protection unit along with sex offenders and child abusers.

Mr Baillieu said any changes to the current system were the responsibility of prison authorities.

"I can understand the sentiment of those who say this shouldn't be happening," Mr Baillieu said.

"Here's someone who really doesn't deserve any sympathy from the community. I understand that, I share that view," he said.
