Carey appeared in Melbourne Magistrates' Court this morning where the court heard details of his alleged scuffle with police at his Port Melbourne apartment on January 27.

Acting Sgt Steve Preece told the court Carey asked security at his apartment complex to call police to have girlfriend Kate Neilson and another female removed.

When police arrived, the court heard Carey repeated his request to have the women taken from his home but would not let police through the door.

Acting Sgt Preece said Carey allegedly pushed one of the officers in the chest and a tussle broke out.

Carey is accused of attempting to headbutt one officer, elbow another in the head and pushed a third back against a wall forcibly enough for the policeman's elbow to go through the plaster.

The court heard Carey was subdued with capsicum spray and arrested.

Carey, 36, faces three counts each of assaulting police and resisting arrest.

Defence lawyer John Carmody told the court there was a serious factual dispute in the case and parties had "given it our best shot" to resolve the case.

He said at contested hearing the defence could call three witnesses - one of whom may be Ms Neilson.

Under questioning from magistrate Peter Reardon police indicated they would not see an immediate custodial sentence for Carey.

The case was adjourned for contested hearing on February 4.
