Shannon Darryl Mcallister sentenced in Townsville District Court for choking, punching, whipping woman

The senseless bashing of a woman that included the man rubbing blood into her mouth, only stopped when she ran to a nearby pub in Townsville and collapsed on the floor, a court has heard. (Warning: Distressing)

A man sat in the dock of a courtroom tapping his foot and shaking his head as he heard the graphic details of his ‘vicious and cruel’ attack on his former partner, that included him choking and punching her over the head.

Shannon Darryl Mcallister appeared angry as he sat in Townsville District Court on Wednesday morning as his attack on his ex-partner was revealed.

Crown prosecutor Ashleigh Moss said on April 16 last year the 41-year-old argued with his former on again, off again partner at their home before he grabbed her by the throat and pushed her against the lounge chair applying pressure for 10 to 15 seconds causing her to be unable to breathe.

Ms Moss said the man punched the woman’s leg, hit her head, shoved her, threatened to kill her and hit her with a metal drink bottle.

“He hit her in the ribs with a closed fist, whipped her with an object across her head, face and body,” the prosecutor explained.

“He spit blood into his hand and forced it into her mouth and grabbed the back of her head pulling it forward with such force she couldn’t breathe, swallow or talk.”

Ms Moss said it only stopped when the woman went to the Rising Sun Hotel where she collapsed and people nearby called an ambulance.

Paramedics when they examined the woman noticed cuts and bruises over her body including the back of her head and eye.

Mcallister was arrested that evening where he spent 345 days in custody before being granted bail.

“The offending itself was a vicious and cruel attack on the complainant,” Ms Moss said.

“Perhaps the most degrading act of all was spitting blood into his hand and forcing it into her mouth.”

Defence barrister Darin Honchin instructed by Stevenson McNamara Lawyers said his client was addicted to methamphetamine and hadn’t undergone rehabilitation other than when he was behind bars.

He said the complainant and the man who is a father of two and has a 6-page criminal history of drug-related offences, had a “toxic” relationship as described by others.

“Whenever arguments arose she would call him a c-ck sucker that triggers him,” Mr Honchin said.

“He needs to get that dealt with but the triggering process causes him to do things.”

Judge John Coker emphasised the seriousness of choking and how it can lead to more serious offences but acknowledged the man had not committed further offences since being released as well as his early plea of guilty.

“Perpetrators and unfortunately they are more often men than women, need to understand that such behaviours will not be accepted and they will come with significant penalties,” His Honour said.

Mcallister pleaded guilty to strangulation, assault occasioning bodily harm and common assault.

He was sentenced to three years’ jail with an immediate parole release date as His Honour declared the 345 days spent in pre-sentence custody as time served.
