Should Cannabis be legal in Australia?

A man has been snapped for drug cultivation and possessing an illegal weapon after police attended his home for unrelated matters.

Daniel Jason Stevenson, 20, was found with five marijuana plants grown by lights and fans at his Townsville home.

The Townsville Magistrates Court heard on June 17 this year police responded to an emergency call at Stevenson’s address after threatening to harm himself and others.

As police aided Stevenson they found two bongs, a glass pipe and a grinder in his bedroom, the court heard.

Police prosecutor Tasman Murphy told the court police were informed that Stevenson was in possession of a taser that looked like a torch which he retrieved out of his bedside table drawer.

Mr Murphy said police noticed a strange light in the corner of the room and found five small cannabis plants standing 10cm tall.

“(Stevenson) stated he knew the seeds were marijuana seeds and he planted them with the intention of growing them to consume,” he said.

“He advised they were two weeks old at the time and he watered them twice daily and cared for them and provided light and fertiliser.”

The plants had electric fans and were surrounded by cardboard, the court heard.

It was accepted by the prosecution that the cannabis plants were not for a commercial use.

Stevenson pleaded guilty to four charges including producing dangerous drugs.

The court heard Stevenson did not have a criminal history.

Defence lawyer Nathan Smith told the court Stevenson was supported in court by his father and inadvertently possessed the taser.

“In relation to the taser, he bought it online and had no clue how effective it would be,” he said.

“It was more of a novelty.”

Magistrate Ken Taylor sentenced Stevenson to a $700 recognisance to be of good behaviour for the next six months.

No convictions were recorded.

Mr Taylor told Stevenson his sentence was “pretty light in the respect of what happened”.

“I have taken into account your character, age, nature of offence and the circumstance in which it was committed,” he said.

“Those matters probably won’t assist too much if you appear before the court again.”
