The bus driver who is accused of killing three people and seriously injuring two others has stormed out of a courthouse saying ‘f-ck em all’ after he did not appear in the correct courtroom.

Greyhound bus driver, Peter Jason Cafe was scheduled to attend the Townsville District Courthouse in person on Friday morning at the request of his Legal Aid defence lawyer.

She said she made the listing as she intended to withdraw from the case as Mr Cafe hadn’t finalised funding and she also requested that his scheduled arraignment date be terminated to give him time to resolve the financial issues.

Crown prosecutor Monique Sheppard opposed the request to have the arraignment date changed as she said it was a “particularly sensitive” matter involving the death of three people.

Mr Cafe faces five charges of driving to cause death or grievous bodily harm. No pleas have been entered.

As Ms Sheppard was proposing that Mr Cafe attend the Legal Aid office, the man frantically walked into the courtroom.

“Good morning your worship, do forgive me I was downstairs in courtroom two down there, nobody told me it was this level,” he said.

Judge Christopher Kahler asked the man to sit down, and said he “strongly” advised him to resolve his financial issues.

Mr Cafe said he was trying and had liaised with his lawyer who was able to submit new financial documentation on his behalf to Legal Aid.

“Believe you me, I am doing my best to cure this situation,” he said.

“Mr Cafe I will stop you there, please liaise with (your lawyer) following the mention this morning. I’m giving you a very strong direction now to resolve whatever funding with Legal Aid,” His Honour said.

“Do you believe I’m not trying to?” the accused asked.

“It’s irrelevant what I think Mr Cafe,” the judge replied.

Judge Kahler said he was not going to reschedule the arraignment date, and kept it at July 4 – but listed the man’s charges for another mention to confirm the financial status of his legal funding.

“Please be at court on time,” His Honour said.

“I did, I checked downstairs,” Mr Cafe replied.

His charges were set for a mention on June 20 at Townsville court.

Mr Café could be heard saying “f-ck em’ all” as he left the courtroom.
