‘It was a stupid OnlyFans video’: Man sentenced for recording sexual assault of sleeping partner

A man who filmed himself sexually assaulting his sleeping partner told police the allegation against him was “rubbish” and that “it was a stupid OnlyFans video”.
The man, who was 27 at the time, filmed the woman asleep in their bed during June 2023, over the course of 90 minutes, with a video camera he’d set up in their wardrobe.
The cannabis and ice user filmed her for nearly 90 minutes, during which time he recorded himself pulling back the bed covers and sexually assaulting her.
The woman ultimately found the video on his phone and reported the matter to police.
“The defendant told police that the allegation was rubbish and that ‘it was a stupid OnlyFans video’,” Supreme Court judge Stephen Estcourt said while sentencing.
Justice Estcourt noted the man’s drug use had started at using cannabis to get to sleep in his 20s before “casually” using ice, but it had “very quickly spiralled out of control and became a life altering addiction”.
The man said it had a devastating impact on his life, his ex-partner, and their two children.
Justice Estcourt said the offending had caused “profound and lasting psychological and emotional effects” on the woman, and that the man had not had contact with his children since the pair’s separation.
“This offending was a very serious breach of trust and should attract a sentence that denounces and deters such conduct as well as vindicating the victim,” he said.
The man, whose name has not been released by the court to protect his ex-partner’s identity, pleaded guilty to one count of indecent assault.
Justice Estcourt sentenced the man to a 12-month home detention order.
The judge recorded the matter as a family violence offence, but did not place the man’s name on the sex offender’s register.
