Tamara Gibbett to be sentenced later this month for two counts of drug trafficking

A drug dealer has been slammed by a judge for asking for a lenient sentence when she has shown no remorse for her crimes.

Tamara Brooke Gibbett, 32, was found guilty of two counts of drug trafficking following a judge-alone trial.

In his published reasons, Judge Paul Muscat rejected her counsel’s claim that there wasn’t enough evidence to prove she occupied the bedroom where the drugs were found.

During a search of a Seaford Rise property on June 19, 2020 police found 22 MDMA capsules, a water bottle containing 607g of fantasy and a homemade taser in a bedroom.

The MDMA was valued at more than $2000 and the fantasy was worth up to $3000.

The court heard a man, who was in another bedroom, was present during the search, while the granny flat appeared to be occupied by another male.

At the time the police attended the property Gibbett was in custody, having been arrested earlier that morning on other charges after she was detected driving in the vicinity of a known drug address at Dover Gardens.

She has pleaded guilty to those offences, including providing false or misleading details to the police and driving while disqualified.

Judge Muscat said he was satisfied that Gibbett solely occupied the bedroom where the drugs were found, due to female clothing and jewellery and a Mother’s Day card from one of her children.

Alex Rice, for Gibbett, asked the District Court this week to impose a low non-parole period for his client to encourage her rehabilitation.

“Why should I do that?” Judge Muscat responded.
“She has expressed no remorse, no contrition, has not accepted responsibility for the offending conduct and she has a rather lengthy criminal history for noncompliance with bail agreement and court orders.”

Mr Rice acknowledged that, telling the court Gibbett had a traumatic childhood and slipped into drug use.

“Illicit drug use slipped into crime,” he said.

The court heard the mother-of-two had been receiving some drug counselling while in prison and had plans to live away from the drug scene when released.

Judge Muscat said based on Gibbett’s criminal history and positive drug tests while on bail, he could safely draw the inference that she was selling to support her own addiction.

He will sentence her later this month.
