Attip Maxwell Smith sentenced over violent Mackay assault while on parole

On parole for stalking, a Qld father of two punched and then pounced on a poor woman in a supermarket carpark for “no reason whatsoever”.

A Mackay father, who was out on parole for stalking, punched a woman and pushed her to the ground, leaving her with ongoing injuries.

It came only about a year after Attip Maxwell Smith rang an ex-partner 367 times using four different numbers and taunting her in front of their kids.

Mackay Magistrates Court also heard Smith, 32, approached the woman at the Bucasia IGA on May 13, 2025, before turning around and walking away again.

The woman then reportedly got out of her car to check on him and “for no reason whatsoever”, Smith ran up to her and punched her.

While the woman tried to get away from him, Smith then pushed her to the ground causing bruising and swelling to her neck, elbow and shoulder.

Aboriginal and Torres Strait Islander Legal Service solicitor Sarah-Jayne Reid acknowledged that her client’s actions were completely unprovoked, and he understood they would have caused a great deal of distress.

Ms Reid compared her client’s crimes to the case of Benje Aron Anthony Hemmett who was given a three-month term of imprisonment for repeatedly punching a man after he was told he wasn’t welcome at his home.

Magistrate Bronwyn Hartigan acknowledged that both cases were similar in nature but that unlike the case of Hemmett, Smith’s victim suffered ongoing injuries, and his attack came out of nowhere.

“It’s not justified in anyway, but there was a reason for (Hemmett’s) assault and there was negotiation between the two about this is how it could end,” she said.

Magistrate Hartigan also took into account his history of violence dating back to 2017 and the fact that he was serving a District Court sentence of two and a half years for stalking, having already served a 250-day pre-sentence custody.

“Common sense would dictate that that would drive it home to you, especially if you want to have a relationship with your kids, that it was time to stop criminal offending,” she said.

The court heard Smith was also caught at an RBT in Mackay driving despite being disqualified.

He pleaded guilty to assault occasioning bodily harm and driving under a disqualified license.

He was sentenced to four months’ jail to be served cumulatively, fined $1500 for driving with a disqualified license and cannot obtain a new license for the next two years.
