Private school sued by man who claims his teacher raped him at school

A Gold Coast private school is being sued for more than $2 million by a man who claims a teacher raped him on school grounds when he was 13.

A man who claims he was raped as a boy by a teacher at his school, while he was being punished for throwing an egg at him, is suing the school for $2.08 million.

The man, now 40, claims he was in year eight at Kings Christian College at Reedy Creek, on the Gold Coast, in 1994 when he was assaulted.

The man claims the alleged sexual assault led him to drug use and being jailed.

He claims he was taking part in a playful fight in the school grounds, as part of celebrations, when he threw an egg that struck the teacher.

The teacher chased him through the school grounds, yelling at him to stop, and when he caught up with him he took him into a storeroom, the claim says.

The teacher began to “remonstrate” with him and punish him for his conduct, by repeatedly shaking him, it is claimed.

The man alleges while he was being punished the teacher turned him around to face the wall and raped him, with his fingers and then his penis.

The man, who was a student at the school for nine years, claims he has suffered from post traumatic stress disorder, major depression and poly substance use disorder, as a result.

He developed some or all of the symptoms soon after the alleged incident when he was 13 and he did not go on to finish year 12, the claim says.

He claims he developed a distrust of authority figures, used alcohol and drugs and has been jailed for drug-related offences since he was assaulted.

The teacher is described in the statement of claim as being “about six foot tall, mid-40s, with brown hair”.

While the teacher has not been named, the claim says his name can be supplied to the court on request.

The statement of claim alleges the private school authorised, permitted or allowed the teacher to discipline the children, have physical contact and mete out corporal punishment.

The student was “highly vulnerable’’ and was expected and required to follow directions from teachers, the claim says.

It is alleged the incident and the student’s injuries were caused by the school’s negligence, as the assaults occurred in the course of the teacher’s employment and while he was disciplining the student.

The claim, against Kings Christian Education, which operates Kings Christian College, is for $2,080,000 for damages for personal injuries and consequential loss.

The law firm representing the school was contacted, but did not respond to a request for a comment and the school is yet to file a response to the court claim.
