A woman who pleaded not guilty to stabbing her ex-boyfriend and his new flame after an alleged argument inside a popular club will face a jury trial after the application to have a judge-alone trial was dismissed in court.

A woman who pleaded not guilty to stabbing her ex-boyfriend and his new flame after an alleged argument inside a popular club will face a jury trial after the application to have a judge-alone trial was dismissed.
Rebecca Elise May Mossman Riley faced Gosford District Court on Friday where she formally entered pleas of not guilty to assault and two counts of intent to cause bodily harm.
Her solicitor applied for an application for a judge-only trial on several grounds, including arguing whether a jury would be able to fully comprehend the evidence and opinion of doctors.
Riley’s lawyer argued that the jury would be undergoing a crash course in psychiatric illness and would not be able to understand the evidence.
Judge David Wilson said he could not see any complex issues in the matter and said the primary issue was whether or not the accused attracted the defence of mental health impairment.
The court heard there was no issue concerning the mental health impairment of Mossman and that experts had reached agreement as to the appropriate diagnosis.
“The only issue for the jury would be whether or not that condition caused her to not know the nature or quality of the act, or alternatively, whether she does not know the act is wrong as perceived by reasonable people”.
“In my view that is a peculiar matter for a jury,” he said.
Ms Riley allegedly bumped into her ex-boyfriend and his new lover at Wyong Leagues Club at Kanwal on January 7, 2023.
Police will allege the trio became involved in a verbal argument before they were all asked to leave about 9.30pm.
However, police will allege in court the fight escalated in the carpark and Ms Riley stabbed her then 29-year-old ex-boyfriend three times in the back, then allegedly stabbed his 31-year-old girlfriend once in the arm and then allegedly left the scene.
The matter will be set for trial on May 26.
