Ourimbah: Daniel Eric Myles sentenced for beating victim with a bicycle pedal

A Central Coast father of two who viciously bashed a man with a bicycle pedal after accusing him of stealing his motorbike has avoided jail.

A father of two who viciously bashed a man with a bicycle pedal after accusing him of stealing his motorbike has avoided jail.

Daniel Eric Myles, 36, was sentenced in Wyong Local Court on Thursday after pleading guilty to a charge of assault occasioning actual bodily harm.

Myles attacked a 20-year-old man at Bill Sohier Park in Ourimbah on April 5 this year.

According to police facts, Myles called out to the victim and began chasing him a short distance before tackling him to the ground.

He then punched the victim in the head and face with his right fist, while holding a bicycle pedal in his hand, which he used as a weapon.

“The accused punched the victim no less than 15 times to the head and face with the pedal in his hand, kneed him in the back, and kicked him in the body and head no less than four times,” court documents state.

The victim was taken to Gosford Hospital with injuries including a laceration to his face and head that required stitches.

Police later arrested Myles in connection with the incident and took him to Wyong Police Station.

He told police the victim had stolen his motorbike and that he used the bicycle pedal as a makeshift knuckle duster.

He admitted to detectives: “I didn’t stab him, but I definitely hit him a lot”, “He stole my motorbike … and he deserved it” and “I followed him and f--ked him up.”

Myles’ lawyer told the court her client was remorseful for his actions.

“His actions are something out of character for Mr Myles,” she said.

Magistrate Alan Railton said he would not impose a jail sentence due to Myles’ early guilty plea and lack of prior history of violence.

Myles was convicted and handed an 18-month Community Corrections Order. He was also ordered to complete 100 hours of community service.
