A Mid-North Coast man on bail for multiple domestic violence charges including choking has had his plea to alter bail conditions rejected, with a magistrate asking “how” the arrangement could possibly work.
A Mid-North Coast man on bail for multiple domestic violence charges including choking has had his plea to alter bail conditions rejected, with a magistrate asking “how” the arrangement could possibly work.
Jeremy Herbert Armstrong is facing two sets of charges and is currently on bail reporting to Macksville Police Station three times a week and with a $2000 guarantee from a family member.
As part of his bail conditions he must not reside with the alleged victim but his lawyer appeared before Magistrate Theresa Hamilton at Macksville Local Police station requesting he be allowed to return to the address because “he is the one paying the rent”.
But Ms Hamilton said Armstrong had been granted bail on December 2 “on the undertaking he lives elsewhere” from the complainant.
“How could he be bailed to the same address?” she asked, adding that he had only recently been granted bail and it was “too soon” to change the conditions.
The 26-year-old is facing several charges in relation to an alleged incident between about 9pm on October 22 and 1am the next day where he allegedly choked and assaulted his partner at the time, smashed her television and a timber door
In relation to the alleged incident he faces four charges including contravening an apprehended domestic violence order; intentionally choking; destroying or damaging property and common assault.
He has pleaded not guilty to the charges.
Since then a fresh charge has been laid - knowingly contravening an apprehended domestic violence order for at least the third time in 28 days. This was alleged to have occurred on November 5.
Armstrong has also pleaded not guilty to that charge.
His matters have been adjourned to June 4 for a hearing.
