EXCLUSIVE: A WOMAN has been charged over filming a nude romp involving ex-Collingwood star Dane Swan and sharing the explicit video online.
Police charged the 20-year-old after an almost four-month investigation into the sexting case, triggered after the Brownlow medallist reported it to police, begging officers to stop it being spread further after the six-second clip started doing the rounds on social media and via text message.
Police will allege she posted the video, showing a nude Swan and a woman kissing in a bed, without his consent.
The woman with the phone camera can be seen laughing as she films Swan’s naked body as he tries to cover his head.
The South Australian woman faces charges of visual capture of genitals (up skirting) and distribution of an intimate image.
Under Victorian sexting laws, people can be jailed for up to two years for distributing intimate images or videos without the person’s consent.
The woman facing the charges yesterday hung up the phone and refused to answer questions when contacted by the Herald Sun.
At the time of the video surfacing Swan, who has been in a relationship with his partner Taylor Wilson for almost 10 years, denied the video was a sex tape.
“Although the video was taken a long time ago, it has been posted and distributed only recently. It was taken and distributed without my consent,” Swan, who retired in 2016, said.
“The distribution is a gross breach of my privacy.”
In a statement to the Herald Sun, Victoria Police said the woman’s offences related to the “capture and distribution of the video”.
“Stonnington Crime Investigation Unit detectives have charged a 20-year-old Meadows (SA) woman in relation to video of a sexual nature alleged to have been distributed electronically and online in May this year,” it said.
“The video was posted without consent.”
She will appear in the Melbourne Magistrates’ Court on December 10.
An embarrassed Swan personally contacted Twitter users who were spreading the video’s images and threatened legal action and to call police unless they removed the X-rated material from their Twitter feeds.
Swan’s nude furore came after a photo of a bare-breasted woman wearing a Richmond premiership medal went viral last year after the Tigers’ triumph.
Despite initially reporting it to police, she later told detectives to drop the investigation.
