AN ASSOCIATE of a man shot dead in Rosebud has been taken into custody this morning after a nine-hour siege, which ended with him being mauled by a police dog.

The 30-year-old Rosebud man, who was in the Ocean St house alone, was arrested just before 7am.

Joshua Dipietro, 31, of Glen Waverley was ambushed and shot in his friend’s car after he had just left a Father Day’s lunch on the Mornington Peninsula on Sunday night.

Police went to the Rosebud house yesterday to speak with a man over the shooting of Mr Dipietro, described by police as an “associate of the victim”.

But the 30-year-old holed himself up in a tent at the rear of the property with a woman.

A couple and three children were in the house.

The man had claimed the woman with him was a hostage.

Detective Insp. Mick Hughes of the homicide squad said the woman left the property at 3.40am and had been able to speak with officers on the phone.

“We successfully negotiated her release about 3.40 this morning and we deployed the Special Operations Group to effect an arrest,” Inp Hughes said.

“She made it clear to us that she wasn’t a hostage.”

Members of the special operations group made their move about 6.30am.

A police dog used in the arrest mauled the man’s leg during the drama.

“He subsequently has been injured by the police dog that was used in that arrest,” Insp Hughes said.

“He is in police custody and is currently seeking medical attention for a severe bite to his leg.”

Insp Hughes said the man was known to police but they had not been able to speak to him yet.

Police believed there were “edged implements” in the tent but the man made no attempt to use weapons during the negotiations with police.

Witnesses heard a series of bangs before the man was dragged outside the house.

Insp Hughes said the man arrested was an associate of the Rosebud shooting victim.

“We actually believe he (the shooting victim) may have been at the house on Sunday,” he said.

“We haven’t had the opportunity to speak with this gentleman yet. We will give him time to have a sleep.”

“We don’t know what role if any he is playing at this stage.”

Mr Dipietro, who was known to police, died in hospital on Monday night.

He was shot while he sat in the passenger seat of the green Mitsubishi 4WD in Rosebud about 8.10pm on Sunday.

He had spent the afternoon with his parents for Father’s Day and his mother had dropped him off at the Dundas St milk bar in Rye before he was picked up by a friend.

“We certainly believe this was a targeted attack,” detective Inspector Michael Hughes said yesterday.

“He was in the area yesterday and had Father’s Day lunch with his parents.

“He spent about four hours with his folks and his mum dropped him off at the Dundas St milk bar and kissed him goodbye and told him she loved him.

“She last saw him sitting on a seat outside the milk bar where we believe he was later picked up by the friend who was with him when he was shot.

“It was very specific. Shots into the car.

“We don’t know a lot about it at the moment. We have spoken to the driver.

“He said the victim said he wanted a drink and we believe they were heading towards the RSL.

“What’s not clear is whether the car has actually broken down or as a result of the shooting the car has stopped.”
