Police criticised for attempt to arrest Bourke St driver’s brother

POLICE have been slammed by a magistrate after calling for the arrest of the injured brother of the alleged Bourke St killer.

POLICE have been slammed by a magistrate after calling for the arrest of the injured brother of the alleged Bourke St killer.

Dimitrious “Jimmy” Gargasoulas allegedly knifed younger brother Angelo hours before setting off on a 12-hour rampage through Melbourne.

Angelo Gargasoulas was due to appear in the Melbourne Magistrates’ Court today on several charges, including damaging property.

On Sunday, the injured man spoke out for the first time from his hospital bed, telling Melbourne to “stay strong”.

“My heart goes out to you and for all those still fighting in hospital, my thoughts are with you and your recovery,” he said on Facebook.

A police prosecutor called for his arrest despite telling the court they believed he was still in hospital recovering from his injuries.

The request disgusted Magistrate Felicity Broughton, who berated Victoria Police.

“He’s the victim of a stab wound and is in hospital,” she said. “You don’t have to be Einstein to understand that’s the situation.”

Ms Broughton said police had no basis to call for a warrant considering Angelo Gargasoulas appeared to be the victim of a “very serious crime”.

“Police should be understanding,” she said.

Ms Broughton was outraged police could not tell her definitely where Angelo Gargasoulas was.

“I don’t need to speculate. I believe the police should be able to tell me,” she said.

Police dumped their application for a warrant, instead asking for a brief adjournment.

“I’d have thought that’s more appropriate,” Ms Broughton said.

She adjourned the matter until Thursday and warned police to get their act together.

“I expect some proper information as to how it’s going to proceed and what is going on.”

The Herald Sun confirmed within the hour of leaving court that Angelo Gargasoulas was in fact discharged from hospital on Monday.

Gargasoulas was in the Alfred Hospital for nine days after suffering extensive injuries in an attack at Windsor.

His injuries were so severe that the homicide squad was called in to investigate.
