He will face a Country Court directions hearing on November 2, three weeks before the election.
Mr McCurdy said today that he planned to plead not guilty.
“There will be certain people trying to put (voters) off, but I have faith in the people of the Ovens Valley that understand the situation as it stands at the moment and we now get an opportunity to have my say a bit further down the track,” Mr McCurdy said outside court.
It is understood he will still run for the safe seat of Ovens Valley, which had a margin of 16.6 per cent at the last election.
